Acceptance of These Terms
These Terms & Conditions govern your access to and use of HarmonyTradingSystem.com and products and services offered by Harmony Trading System, including Harmony Trading Edge™, software, indicators, educational materials, livestreams, trading rooms, memberships, subscriptions, training sessions, research, support, and related content.
By accessing the website, purchasing or activating a product, requesting a trial, joining a membership, or using our services, you agree to these Terms, our Risk Disclosure, Privacy Policy, and any additional terms presented at purchase or activation. If you do not agree, do not use the website or services.
Educational Purpose; No Investment Advice
Harmony Trading System provides educational tools and information. We are not acting as your broker, registered investment adviser, commodity trading adviser, or fiduciary. Nothing on the website or in our software, classes, communications, streams, trading rooms, research, or other content is personalized financial or trading advice or a recommendation to buy, sell, or hold any financial instrument.
Trading involves substantial risk. You are solely responsible for your trading decisions, orders, risk management, and financial results. Review our Risk Disclosure & Disclaimer Statement before using our products or services.
Purchases, Subscriptions, and Billing
Prices, plan features, billing intervals, license limits, promotional offers, and included services are those displayed at the time of purchase unless otherwise stated in writing. Monthly or annual plans may renew according to the terms presented by the payment provider. You are responsible for managing any recurring payment authorization through the applicable payment provider or by contacting us when assistance is available.
Payments may be processed by third parties such as PayPal. Their terms and privacy practices also apply to transactions they process. Harmony Trading System does not control a third-party payment provider’s processing times, availability, or account requirements.
Refund Policy
Because our products may include immediately delivered software licenses, digital intellectual property, educational materials, access credentials, onboarding, and other non-returnable digital services, all sales are final and non-refundable except where a refund is required by applicable law or expressly promised in writing by Harmony Trading System for a specific offer.
Before purchasing, review the product description, price, billing interval, included services, system requirements, and trial options. Failure to use a purchased product, failure to attend included training, changes in personal trading results, or dissatisfaction with market performance does not by itself create a right to a refund.
Trials
A free trial is offered for evaluation of Harmony Trading Edge™ under the terms displayed on the trial page. Trial length, features, eligibility, activation requirements, and availability may change. A trial may require a valid NinjaTrader Machine ID and contact information. Trial access may be limited to one trial per person, household, device, or Machine ID. We may refuse or end a trial where we reasonably believe there is abuse, duplication, fraud, unauthorized sharing, or violation of these Terms.
Software License
Unless a separate written license states otherwise, software provided by Harmony Trading System is licensed—not sold—to you for your personal use. Your license is non-exclusive, non-transferable, and subject to the plan and activation limits shown when you purchase or activate the software.
You may not copy, redistribute, resell, sublicense, publish, broadcast, share, rent, lease, decompile, reverse engineer, circumvent licensing controls, remove proprietary notices, disclose source code, create unauthorized derivative products, or allow another person to use a license assigned to you, except to the extent a restriction is prohibited by applicable law.
Commercial redistribution or use of Harmony Trading System software as part of a competing product, paid advisory service, signal service, commercial trading room, software bundle, or resale offering is prohibited unless we provide prior written permission.
Software activation may use device identifiers or Machine IDs. Changing computers, hardware, or platform configuration may require reactivation and may be subject to the license limits of your plan.
Intellectual Property
The Harmony Trading System name, Harmony Trading Edge™, website design, software, code, indicators, strategies, manuals, videos, graphics, educational materials, documentation, branding, and other original content are owned by or licensed to Harmony Trading System and are protected by applicable intellectual-property laws.
No rights are granted except the limited right to use purchased or authorized materials in accordance with these Terms. You may not reproduce, distribute, modify, republish, sell, or commercially exploit our content without prior written permission.
Third-Party Platforms and Services
Harmony products may be designed to work with third-party platforms, brokers, data feeds, websites, or services. Those third parties operate independently and may change pricing, features, technical requirements, APIs, rules, or availability at any time. Harmony Trading System is not responsible for third-party outages, changes, errors, losses, fees, or service decisions.
Some links on our website may be affiliate links. If you use an affiliate link and complete a qualifying transaction, Harmony Trading System may receive compensation at no additional cost to you unless otherwise stated.
NinjaTrader Platform Disclaimer: Neither NinjaTrader nor any of its affiliates has reviewed, certified, endorsed, approved, disapproved or recommended any trading software tool designed to be compatible with the NinjaTrader Open Platform.
Trading and Performance Disclaimers
There is no guarantee that you will be profitable or achieve any particular result from our software, education, community, or services. Past performance is not necessarily indicative of future results. Hypothetical or simulated performance has inherent limitations and does not represent actual trading under all real-world conditions.
Testimonials, screenshots, livestreams, examples, or results shown on our website or in our communications may not be representative of other users and do not guarantee future performance or success.
Acceptable Use
You agree not to use our website or services to violate law; infringe intellectual-property or privacy rights; distribute malware or harmful code; attempt unauthorized access; interfere with website or licensing systems; impersonate another person; submit fraudulent information; scrape or extract protected content for unauthorized commercial use; or misuse trials, licenses, payment systems, support channels, or community access.
Chargebacks and Payment Disputes
If you believe a billing error has occurred, contact us promptly so we can investigate. If a chargeback, payment reversal, or payment dispute is initiated, we may suspend related licenses, memberships, downloads, or services while the dispute is reviewed. Fraudulent purchases, unauthorized sharing, or abusive payment disputes may result in termination of access and other remedies available by law.
Availability, Updates, and Support
We may update, replace, improve, discontinue, or change software features, educational content, website functions, community features, pricing, or services. We do not guarantee uninterrupted availability of any website, stream, room, download, server, third-party platform, data source, or support channel.
Where an offer includes updates or support, the scope of those benefits is governed by the description of that offer and these Terms. We may require supported versions of NinjaTrader, Windows, or other software to provide technical support.
Disclaimer of Warranties
To the fullest extent permitted by law, the website, software, content, education, and services are provided on an “as is” and “as available” basis. Harmony Trading System disclaims express and implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted operation, and error-free performance.
We do not warrant that software or content will meet your particular trading goals, that signals or data will be accurate or timely, or that operation will be uninterrupted or free from defects.
Limitation of Liability
To the fullest extent permitted by law, Harmony Trading System and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits; trading losses; loss of data; loss of business opportunity; or damages arising from market activity, third-party platforms, technical failures, or reliance on educational information.
Some jurisdictions do not permit certain exclusions or limitations, so portions of these limitations may not apply to you. Nothing in these Terms excludes liability that cannot legally be excluded.
User Communications and Submitted Material
If you send us feedback, testimonials, reviews, suggestions, or other material, you represent that you have the right to provide it and that it does not violate another person’s rights. We may use feedback to improve our products. We will not publicly use a customer testimonial, name, image, or identifiable endorsement in marketing without the permissions required by applicable law or our internal consent process.
Copyright and Intellectual-Property Complaints
If you believe material on our website infringes your copyright or other intellectual-property rights, send a written notice identifying the work, the allegedly infringing material and its location, your contact information, and a statement explaining your good-faith belief that the use is unauthorized. Changes to These Terms
We may revise these Terms from time to time. The “Last updated” date identifies the current version. Your continued use of the website or services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law. Material changes affecting an existing paid subscription may also be communicated through reasonable channels when appropriate.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute that is not subject to another enforceable dispute-resolution agreement will be handled in a court of competent jurisdiction as permitted by law.
Force Majeure
Harmony Trading System is not responsible for delay or failure to perform caused by events reasonably beyond its control, including natural disasters, power or Internet failures, exchange or market closures, acts of government, war, terrorism, civil disturbance, labor disputes, epidemics, widespread technology failures, or failures of essential third-party services.
Severability
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
